General
- The Discover Website is owned by the Government of Singapore as represented by the National Youth Council ("we" "us" or "our"). These Terms of Use (these "Terms") govern your use of Discover. Please read these Terms carefully.
- By using the Discover Website:
- you agree to these Terms; or
- where you are below 18 years old, your parent or legal guardian agrees to these Terms on your behalf.
If neither (a) nor (b) applies, please do not use the Discover Website. If you have any question about Discover, its Privacy Policy, these Terms, or Discover Programmes, please contact us at enquiries@nyc.gov.sg.
- You will need an account on the Discover Website (“Account”) to access certain of its features, including the option to register for Discover Programmes. Please refer to paragraph 5 of these Terms for more details.

Interpretation

In these Terms, unless otherwise defined or the context otherwise requires:
"Discover” means the Discover Website and Discover Content.
“Discover Content” means content provided by us or our third party service providers on the Discover Website.
“Discover Programmes” means activities or programmes offered by us or our third party service providers through the Discover Website.
“Discover Website” means the website at discover.nyc.gov.sg or such other website as may be specified by us.
“IP” means patents, copyright, trade marks, service marks, trade names, domain names, get-ups, inventions, registered and unregistered design rights, database rights, integrated circuit topography, geographical indications and all other similar rights of whatever nature wherever in the world arising, in each case: (i) whether registered or not; (ii) including any applications to protect or register such rights; (iii) including all renewals and extensions of such rights or applications; (iv) whether vested, contingent or future; and wherever existing.
“Losses” means all liabilities, losses, damages, actions, claims, demands, costs (including legal costs on a full indemnity basis and experts’ and consultants’ fees), settlement sums and sums paid in satisfaction of a court, arbitral or expert award.
“Myinfo” means the data sharing platform known as "Myinfo", provided by the Government Technology Agency on behalf of the Government of Singapore, which a person may use to authorise the automatic filling-out of e-forms with, among other things, his or her personal data.
“Person” and “Party” include any company or association or body of persons, corporate or unincorporate.
“Personal data” has the same meaning as set out in the Personal Data Protection Act 2012.
“Singpass” means the electronic identification, authentication or authorisation service of the Government of Singapore known as “Singpass”.

Usage terms
- You agree to comply with all guidelines, notices, rules and policies and instructions issued by us relating to Discover and Discover Programmes, any amendments to the aforementioned issued by us from time to time, as well as all applicable laws and regulations.
- You agree that you will not, directly or indirectly ―
- use Discover for any unlawful activity or purpose;
- use Discover for any commercial purpose or for the benefit of any other person, save where authorised by us;
- use Discover in breach of these Terms;
- reproduce or modify any Discover Content, save where authorised by us;
- upload, post or transmit any content to or through the Discover Website that ―
- is contrary to the law;
- is false, offensive, defamatory, inaccurate, misleading or fraudulent;
- infringes the rights (including IP) of any person; or
- amounts to spam or advertisement;
- harass or solicit personal information from any user of the Discover Website;
- misrepresent or make false or misleading claims regarding Discover and Discover Programmes;
- remove, circumvent, impair, bypass, disable or otherwise interfere with any feature of the Discover Website, including any feature that prevents or restricts access or use of any ―
- feature of the Discover Website;
- Account; or
- content on the Discover Website (including Discover Content);
- use any device, software, exploits, or routine, including any virus, Trojan horse, worm, time bomb, robot, spider, data-mining or data scraping tool or cancel bot intended to damage or interfere with the operation of the Discover Website or to intercept or expropriate any content on the Discover Website (including Discover Content);
- use the Discover Website in any manner that could damage, disrupt, disable, overburden, or impair the operation of the Discover Website or interfere with any person’s authorised use of Discover; and
- modify, reverse-engineer, decompile, adapt, publish, redistribute or interfere with or intercept any transaction which is part of the Discover Website.
- You represent and warrant that all information provided by you for the purposes of creating an Account and registering for Discover Programmes are true, accurate and up to date.
- Subject to these Terms, we give you personal, non-exclusive and revocable permission to use the Discover Website.
- You are responsible for all costs and expenses in relation to or arising from your use of the Discover Website, including charges for Internet access to use the Discover Website.

Privacy Policy
- We may collect data (including personal data) from you and use and disclose the data in accordance with the Privacy Policy here. You agree to the terms of the Privacy Policy as may be amended from time to time.

Creation etc. of Account
- To create an Account, you will need to log into your Singpass account and authorise Myinfo to automatically fill-out fields in the Account creation form on the Discover Website.
- You agree that you will not, directly or indirectly ―
- access, log into or use any Account that is not yours, or which you are not authorised to access, log into or use;
- transfer your Account to any other person;
- disclose your Account details, including the login credentials to your Account, to any other person.
- You are responsible for the confidentiality and security of your personal information and Account details, including the login credentials to your Account. You must notify us immediately if you know or suspect the confidentiality and/or security of your Account details has been compromised. To protect the confidentiality and security of your Account details, we may require you, from time to time, to change the login credentials to your Account and agree to do so when required.
- You agree that we may hold you responsible for any use of Discover, whether or not authorised by you, referable to your Account.
- We may delete your Account, or suspend or restrict your access to it, in accordance with paragraph 6.1(e) of these Terms.
- You may delete your Account by writing to us at enquiries@nyc.gov.sg with reasonable notice.

Reservation of rights
- We reserve the right to ―
- suspend access to the Discover Website (including content on the Discover Website) at any time, whether for maintenance of the Discover Website or otherwise, without notice or liability to you;
- update, enhance, upgrade, reduce, or otherwise make changes to Discover at any time without notice or liability to you. These Terms will apply to all such updates, enhancements, upgrades, reductions or changes to Discover;
- discontinue Discover at any time without notice or liability to you;
- discontinue Discover Programmes at any time without notice or liability to you, save that notice will be given to you in respect of the discontinuation of any one or more Discover Programmes that you have registered for;
- suspend, restrict or terminate your access to the Discover Website (including content on the Discover Website) and your Account at any time, without notice or liability to you, in any one or more of the following circumstances:
- where required to comply with any order or request of any court, government body, regulatory authority or law enforcement agency;
- to prevent any misconduct, fraud or unlawful activity through the use of your Account;
- where we suspect or have reason to believe that inaccurate, misleading, false or fraudulent information has been provided by you or through your Account;
- where we suspect or have reason to believe that there has been any misconduct, fraud or unlawful activity through the use of your Account;
- where we suspect or have reason to believe that you are in breach of these Terms.
- We reserve the right to determine if and in what manner we may reinstate your access to the Discover Website (including content on the Discover Website) and your Account. This includes stipulating one or more conditions that you must comply with for such reinstatement.
- We reserve the right to review content uploaded, posted or transmitted to and through the Discover Website. We reserve the right to remove any content uploaded, posted or transmitted by you to or through the Discover Website that we suspect or have reason to believe is in breach of paragraph 3.2(e) these Terms. You are solely responsible for any content that you upload, post or transmit to or through the Discover Website.

Disclaimers and release
- The Discover Website, content on the Discover Website and Discover Programmes are provided “as is” and “as available” without any representation or warranty, whether express or implied, by us. Without prejudice to the generality of the foregoing, we do not make any representation or warranty ―
- as to the accuracy, completeness, correctness, currency, timeliness, reliability, availability, interoperability, security, non-infringement, title, quality, propriety or fitness for any particular purpose of the Discover Website, content on the Discover Website and Discover Programmes;
- that the Discover Website, content on the Discover Website and Discover Programmes will be continuously accessible, uninterrupted or free of errors and defects, or that any error or defect will be corrected; or
- that the Discover Website and content on the Discover Website are and will be free of virus or other harmful elements.
- We and our employees and agents will not be liable for any injury or damage you suffer in relation to or arising from your use or inability to use the Discover Website (including content on the Discover Website). Without prejudice to the generality of the foregoing, we and our employees and agents will not be liable for any injury or damage you suffer in relation to or arising from ―
- your reliance on content on the Discover Website;
- your interaction with any user of the Discover Website;
- the conduct of any user of the Discover Website;
- your interaction with any of our third party service providers;
- the conduct of any of our third party service providers; or
- any disruption to or malfunctioning of the Discover Website.
- If any dispute arises between you and any one or more of our third party service providers, you agree to release us and our employees and agents from any and all Losses in relation to or arising from the dispute.
- If any dispute arises between you and any one or more users of the Discover Website, you agree to release us and our employees and agents from any and all Losses in relation to or arising from the dispute.
- Our third party service providers will not be liable for any injury or damage you suffer in relation to or arising from ―
- your interaction with any user of the Discover Website;
- the conduct of any user of the Discover Website; or
- content uploaded, posted or transmitted to or through the Discover Website by any user of the Discover Website.”
- The Discover Website, content on the Discover Website and Discover Programmes are provided “as is” and “as available” without any representation or warranty, whether express or implied, by us. Without prejudice to the generality of the foregoing, we do not make any representation or warranty ―

Conduct of other users
- We are not responsible or liable for the conduct of users of the Discover Website or for the content uploaded, posted or transmitted to or through the Discover Website by users of the Discover Website. We do not actively screen such content, and only act as a passive conduit for the publication or transmission of such content on or through the Discover Website. Any opinions, advice, statements, services, offers, or other information provided on or through the Discover Website by users of the Discover Website are those of the respective users and not us. We neither endorse nor warrant the accuracy, completeness, correctness, reliability, propriety or usefulness of such content.
- Users of the Discover Website are responsible for ensuring that content uploaded, posted or transmitted by them to or through the Discover Website does not infringe any applicable laws, including without limitation, laws relating to defamation, libel and slander, laws of confidentiality and non-disclosure, and laws relating to copyright, trade secret or other IP of another person. A user of the Discover Website shall be solely liable for any injury or damage suffered by a person resulting from any infringement of any applicable laws, including without limitation, laws relating to defamation, libel and slander, and laws relating to copyrights, trade secret, or other IP, or any other harm resulting from his or her uploading, posting or transmission of content to or through the Discover Website.

Third party websites
- We may include links to third party websites on the Discover Website, either for marketing purposes or otherwise. These links are provided for your convenience only and do not imply endorsement by, association or affiliation with us of the contents of or provider of the third party websites. We will not be responsible for the availability or content of the third party websites and will not be liable for any injury or damage arising from your access to or use of the third party websites. Access to and use of the third party websites are entirely at your own risk.
- If you use a third party website, you should read and comply with its terms.
- Hyperlinking to and framing of the Discover Website, in whole or in part, are prohibited without our prior written consent. In giving consent, we may impose such conditions as we deem appropriate. If you hyperlink to or frame the Discover Website, in whole or in part, that will constitute your acceptance of these Terms. If you do not accept these Terms, you must immediately discontinue hyperlinking to or framing of the Discover Website.
- We are not affiliated in any way with any trademarks, logos, insignia, or devices used or appearing on third party websites that link to the Discover Website or any part of it. We disclaim any responsibility for websites and materials that link to or frame the Discover Website or any part of it.
- We reserve the right to disable or block any links to, or frames of any website or content which ―
- implies endorsement by or association or affiliation with us; and/or
- is inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful.
- We reserve the right to disable or block any unauthorised links or frames.

Indemnity
- You agree to indemnify and keep us indemnified against any and all Losses sustained, incurred, paid by or suffered by us in relation to or arising from your use of the Discover Website, content on the Discover Website and/or Discover Programmes, unless you can show that:
- it is not due to any breach by you of these Terms; and
- it is not due to the negligent, unlawful or wrongful action or omission, fraud, bad faith, wilful misconduct or breach of any duty you owe.
- If any claim is commenced against us that is, in our opinion covered by paragraph 10.1 of these Terms, we shall have the right to:
- defend the claim in such manner as we may deem appropriate, at your sole cost and expense; or
- notify you about the claim as soon as practicable, in which case you shall immediately take control of the defence and engage reasonably competent lawyers to defend the same (including for and on our behalf), at your sole cost and expense.
- You agree to indemnify and keep us indemnified against any and all Losses sustained, incurred, paid by or suffered by us in relation to or arising from your use of the Discover Website, content on the Discover Website and/or Discover Programmes, unless you can show that:

Access from overseas
- We do not represent or warrant that content on the Discover Website is suitable or accessible in other countries. If you access the Discover Website from outside Singapore, it is your responsibility to follow the laws in the country that you are accessing the Discover Website in.

Changes to these Terms
- We may change these Terms at our discretion and at any time, by posting the changed Terms on the Discover Website. Your continued use of the Discover Website after the posting of the changed Terms will constitute your acceptance of the changed Terms. If you do not accept the changed Terms, please stop using the Discover Website.

Governing law and dispute resolution
- These Terms will be governed by and construed in accordance with the laws of Singapore.
- Subject to paragraph 13.3 of these Terms, any dispute in relation to or arising from these Terms, including questions regarding the existence, validity or termination of these Terms, will be referred to and finally resolved in the courts of Singapore and you submit to the exclusive jurisdiction of the courts of Singapore.
- In the event of a dispute referred to in paragraph 13.2 of these Terms, you agree to make reasonable efforts to settle the matter with us in good faith through negotiations.

Miscellaneous
- Any termination of your Account or your use of or access to Discover under these Terms (howsoever occasioned) will not affect the coming into force or the continuance in force of any provision of these Terms which is expressly or by implication intended to come into or continue in force on or after such termination.
- If any provision of these Terms is held by a court or tribunal of competent jurisdiction to be invalid or unenforceable, then these Terms, including all remaining provisions, will remain in full force and effect as if such invalid or unenforceable provision had never been included.
- No delay by us in enforcing any provision of these Terms will be construed to be a waiver of any of our rights under that provision.
- Any notice that we intend to give to you may be posted on the Discover Website or sent to you to any contact information you may have provided us with through your Account or otherwise. You are deemed to have received notice of the same upon us posting or sending such notice to you.
- Subject to the rights of any third party for which paragraph 7 of these Terms applies, a person who is not a party to these Terms will have no right under the Contracts (Rights of Third Parties) Act 2001 or otherwise to enforce any of the provisions in these Terms.
